Picarta is an AI-powered geolocation service that identifies locations from uploaded images.

1.1 Acceptance of Terms

By accessing or using Picarta, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our services.

1.2 Age Requirement

You must be at least 16 years old to use Picarta. By using our services, you confirm that you meet this age requirement. If you are under 16, please do not use our services.

1.3 Account Registration

• You can use Picarta without an account with limited features
• Registered users gain access to additional features
• You are responsible for maintaining the security of your account credentials
• You must provide accurate information when creating an account
• Notify us immediately if you suspect unauthorized access to your account
• If you use Picarta on behalf of an organization, you confirm that you are authorized to bind it to these terms, and "you" refers to that organization

1.4 Service Description

Picarta offers:

• Free Tier: Limited access to our geolocation services.
• Premium Features: Enhanced functionality for paid users.

We use artificial intelligence to analyze uploaded images and identify the location where the photo was taken. Results are estimates and may not always be completely accurate.

1.5 Payment and Refund Policy

Pricing and Taxes:
Premium features require payment. Pricing details are available on our website and during the subscription process. Prices exclude VAT, sales tax, and similar taxes, which are added at checkout based on your location. Payments are processed by Stripe; we do not store your card details.

Subscriptions:
Subscriptions renew automatically at the end of each billing period until canceled. You can cancel at any time from your account page; cancellation takes effect immediately. Quota included in a subscription resets at each renewal; unused quota does not roll over.

Wallet Credits:
Wallet credits expire 6 months after the date of purchase. Expired credits cannot be used or refunded.

Quota Adjustments:
API call allocations, website search quotas, and other usage limits included in subscription plans may be adjusted to reflect changes in computational costs. Changes take effect from your next billing period. If you do not agree, you may cancel before the change applies.

Refund Policy:
We want you to be satisfied with our service. If you are not satisfied with your purchase, you may request a full refund within 14 days from the date of purchase. To request a refund, contact us at [email protected] with your account details and order information.

Wallet purchases can only be refunded within this 14-day period. For subscriptions, refund requests made after the 14-day period will be evaluated on a case-by-case basis at our sole discretion.

1.6 Acceptable Use

You agree to use Picarta responsibly and legally. You must not:

• Upload images that violate any laws or regulations
• Upload images containing illegal content or depicting illegal activities
• Upload images that infringe on others' intellectual property rights or privacy
• Use our services to harass, stalk, threaten, or harm others
• Upload images of children under 16 years old, except in cases of legitimate concern for safety or law enforcement purposes
• Attempt to reverse engineer, hack, or compromise our systems
• Use automated tools to scrape or extract data from our services
• Engage in any activity that disrupts or interferes with our services
• Resell, sublicense, or provide our services or results to third parties as a service, unless agreed with us in writing
• Use our services or results to develop a competing product or to train AI models

You are solely responsible for ensuring you have the necessary rights and permissions to upload images to our service.

1.7 Content and Intellectual Property

Your Content:

• You retain all ownership rights to the images you upload
• By uploading images, you grant us a limited license to process them solely to provide our geolocation services

Our Intellectual Property:

• All content, features, and functionality of Picarta are owned by Picarta and protected by copyright and intellectual property laws
• You may not copy, modify, distribute, or create derivative works without our written permission

1.8 Service Availability and Modifications

• We strive to keep Picarta available but cannot guarantee uninterrupted service
• We may modify, suspend, or discontinue any part of our services at any time
• We reserve the right to update these terms and will notify you of material changes

1.9 Disclaimers and Limitations

No Warranties:
To the extent permitted by applicable law, Picarta is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or that the service will be uninterrupted or error-free. This does not affect any statutory rights you have as a consumer under the law of your country.

Accuracy:
Location predictions are statistical estimates and may be inaccurate. You are solely responsible for how you use the results and must not rely on them alone for legal, safety, investigative, or other critical decisions.

Limitation of Liability:
To the extent permitted by applicable law, Picarta and its directors, employees, licensors, and suppliers are not liable for any indirect, incidental, special, punitive, or consequential damages, including loss of profits, revenue, data, goodwill, or business interruption, damages arising from decisions made on the basis of our results, or failures caused by events beyond our reasonable control. Our total liability for all claims shall not exceed €100.

This limit does not apply to damage we cause intentionally or through gross negligence, or where the law does not allow liability to be limited.

1.10 Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold Picarta harmless from any claims, damages, or expenses, including reasonable legal fees, arising from your use of our services or violation of these terms.

1.11 Termination

• You may stop using Picarta at any time
• You may delete your account at any time from your account settings page or by contacting us at [email protected]
• We may suspend or terminate your access if you violate these terms
• Upon termination, your right to use our services ends immediately
• Sections 1.7, 1.9, 1.10, 1.12, and 1.15 survive termination

1.12 Governing Law and Dispute Resolution

These terms are governed by the laws of Italy. Any disputes will be resolved exclusively by the courts of Siena, Italy.

If you are a consumer, you also keep the protection of the mandatory laws of your country of residence and may bring claims in the courts of that country where those laws allow it.

1.13 API Access

• API access is available only on eligible plans and requires an API key issued to your account
• Keep your API keys confidential; you are responsible for all usage made with them
• Rate limits and quotas apply, and we may suspend keys used abusively or in breach of these terms

1.14 Export Controls and Sanctions

You may not use Picarta if you are located in, or are a national or resident of, a country or region subject to comprehensive EU, UN, or US sanctions, or if you are listed on any applicable sanctions list. You must not use or make our services available in breach of applicable export control or sanctions laws.

1.15 General Provisions

• Entire agreement: These terms, together with any written agreement signed with us, are the entire agreement between you and Picarta. If they conflict, the signed agreement prevails
• Assignment: You may not transfer your rights under these terms without our written consent. We may transfer them in connection with a merger, acquisition, or sale of assets
• Severability: If any provision is found invalid, the remaining provisions remain in effect
• No waiver: Failure to enforce a provision is not a waiver of our right to do so later
• Force majeure: We are not responsible for failures caused by events beyond our reasonable control
• Language: These terms are drafted in English; translations are for convenience only

Picarta may update these Terms of Service from time to time to reflect regulatory changes or improvements to our Services. Material changes will be published on this page and, where appropriate, notified via email to registered users. Continued use of the Services after such updates constitutes acceptance of the revised terms.
